I think we all know that “private security forces” actually means mercenaries – hired guns – private armies - folks who do the exact same job as our troops, get paid a shitload more money and operate outside the laws of Iraq and those here at home.

In other words – they can literally get away with murder (and they have) and BO is keeping open his options when it comes to using them on the ground in Iraq. Maybe that’s why he says he’ll bring our combat troops home but he refuses to declare he will end the occupation entirely.

Senator Clinton Cosponsors Legislation to Ban Use of Private Security Contractors in Iraq and Afghanistan

Washington, DC – Senator Hillary Rodham Clinton announced today that she has cosponsored legislation to ban the use of Blackwater and other private mercenary firms in Iraq.

"From this war's very beginning, this administration has permitted thousands of heavily-armed military contractors to march through Iraq without any law or court to rein them in or hold them accountable. These private security contractors have been reckless and have compromised our mission in Iraq. The time to show these contractors the door is long past due. We need to stop filling the coffers of contractors in Iraq, and make sure that armed personnel in Iraq are fully accountable to the U.S. government and follow the chain of command," said Senator Clinton.

The legislation requires that all personnel at any U.S. diplomatic or consular mission in Iraq be provided security services only by Federal Government Personnel. It also includes a whistleblower clause to protect contract personnel who uncover contract violations, criminal actions, or human rights abuses.

A senior foreign policy adviser to leading Democratic presidential candidate Barack Obama has told The Nation that if elected Obama will not "rule out" using private security companies like Blackwater Worldwide in Iraq. The adviser also said that Obama does not plan to sign on to legislation that seeks to ban the use of these forces in US war zones by January 2009, when a new President will be sworn in. Obama's campaign says that instead he will focus on bringing accountability to these forces while increasing funding for the State Department's Bureau of Diplomatic Security, the agency that employs Blackwater and other private security contractors.

"If Barack Obama comes into office next January and our diplomatic security service is in the state it's in and the situation on the ground in Iraq is in the state it's in, I think we will be forced to rely on a host of security measures," said the senior adviser. "I can't rule out, I won't rule out, private security contractors." He added, "I will rule out private security contractors that are not accountable to US law."

But therein lies a problem. The US Embassy in Iraq is slated to become the largest embassy in world history. If Obama maintains that embassy and its army of diplomats and US personnel going in and out of the Green Zone, which his advisers say he will, a significant armed force will be required for protection. The force that now plays that role is composed almost exclusively of contractors from Blackwater, DynCorp and Triple Canopy. And at present, these contractors are not held accountable under US law. Obama and a host of legal experts, including in the Justice Department, acknowledge that there may be no current US law that could be used to prosecute security contractors for crimes committed in Iraq, such as the killing of seventeen Iraqi civilians last September in Baghdad's Nisour Square.

Obama's proposed increase in funding to the diplomatic security division would ostensibly pave the way for a protective force composed entirely of US government personnel, but the process of building that force would likely take a long time. Short of dramatically reducing the US civilian and diplomatic presence in Iraq that necessitates such a security force, Obama may have no choice but to continue the contracting arrangements with firms like Blackwater if he is elected President.

The irony is that it was Senator Obama who sponsored a bill in February 2007 defining a legal structure to prosecute State Department contractor crimes in US courts. Obama staffers say they will "fight like hell to get it passed." But it may not pass before the next President takes power. Even if it does and Bush signs it, serious questions will remain unresolved about how contractor crimes can be monitored effectively. The senior adviser acknowledged that Obama could find himself in a situation where, as President, he continues using forces he himself has identified as "unaccountable." The Obama campaign, in other words, may have painted itself into a corner.

Obama campaign and Senate staffers characterize this as an inherited problem with no good alternatives. "We are in a situation where, because of bad planning and a series of disastrous policy choices by the Bush Administration, we're forced to rely on private security contractors," says the senior adviser. "What we're focused on at the moment is getting the legal architecture in place that will hold these guys accountable to the same standard that [applies to] enlisted US military personnel."

In Iraq right now, the number of private contractors is basically equal to the number of US troops. While Obama advisers say they plan to "have a serious look" at the role of contractors in Iraq, one adviser seemed to indicate that unarmed contractors would continue to operate at significant levels. "These contractors are not only providing private security functions like Blackwater. They're rebuilding schools, they are serving food, they're doing logistics, they're driving trucks, and the important question is, If you take those 100,000-plus contractors out of Iraq, what do you replace them with? Inevitably the answer is, You replace them with US military."

But, the senior adviser notes, "ideally we would have diplomatic security personnel, US government personnel, not subcontracted but US Bureau of Diplomatic Security agents providing security to all our ambassadors."

Says another Obama adviser, "If we could start this whole war from the beginning, what would we have done versus what can we do now, now that we're in the middle of it? In an ideal world, we would not have these contractors, but that's not the world we operate in right now."

The State Department has only an estimated 1,450 diplomatic security agents worldwide who are actual government employees, and only thirty-six are deployed in Iraq. In contrast, Blackwater has nearly 1,000 operatives in Iraq alone, not to mention the hundreds more working for DynCorp and Triple Canopy. Moreover, the State Department says it could take years to identify prospective new agents, vet them, train them and deploy them. In short, this would be no small undertaking by a President Obama. As Ambassador Ryan Crocker said in late 2007, "There is simply no way at all that the State Department's Bureau of Diplomatic Security could ever have enough full-time personnel to staff the security function in Iraq. There is no alternative except through contracts."

Making diplomatic security a military operation would pose serious challenges as well. As the New York Times reported late last year, "the military does not have the trained personnel to take over the job." Even if the military trained a specialized force for executive protection and bodyguarding in Iraq, this arrangement would mean more US military convoys traveling inside Iraq, potentially placing them in deadly conflict with Iraqi civilians on a regular basis.

The private security industry knows well that it has become a central part of US policy in Iraq and Afghanistan. Extricating the firms from this position would require a major and aggressive undertaking with significant Congressional support, which is by no means guaranteed. In fact, Blackwater appears to see a silver lining in the prospect of US forces being withdrawn or reduced in Iraq. Joseph Schmitz, chief operating officer of Blackwater's parent company, The Prince Group, said, "There is a scenario where we could as a government, the United States, could pull back the military footprint, and there would then be more of a need for private contractors to go in." The Obama senior adviser called Schmitz's comment "an unfortunate characterization."

Illinois Democrat Jan Schakowsky, one of Congress's sharpest critics of the war contracting system, says of Schmitz's remark, "That's why some of us have been really careful about not just talking about a troop withdrawal but a contractor withdrawal as well." Obama, she says, should make it impossible for Schmitz and others "to think that Barack Obama would be creating new opportunities for Blackwater after our troops are withdrawn." The clearest way for him to do that would be to endorse legislation banning the use of Blackwater and other mercenary firms in Iraq. In November Schakowsky and Vermont Senator Bernie Sanders introduced the Stop Outsourcing Security (SOS) Act, which mandates that US personnel undertake all diplomatic security in Iraq within six months of enactment. The bill has twenty-three co-sponsors in the House and one--Sanders--in the Senate. Sanders said he'd "love" it if Obama and Clinton signed on. "If either of them came on board, we'd certainly see more Democratic support," says Sanders. Will Obama do that before November? "The answer is no, in all candor," says the senior Obama adviser. "Obviously it's a dynamic situation, and he'll continue to analyze it."

Schakowsky is pressing Obama to support the bill and says that if he becomes President she will urge him to "cancel" any remaining Blackwater contract in Iraq: "There's plenty of justification to say this company is trouble, and there's no point in continuing our contract with them."

The senior adviser said, "Senator Obama is concerned that Blackwater remains in Iraq, and he's concerned that they remain in Iraq and other countries totally unaccountable to US law and totally unaccountable to the law in the country in which they are operating." Which raises the question: If he's so concerned, why not throw his support behind a ban on the use of these forces in Iraq?

IN OTHER WORDS: I WILL TELL YOU I'M PULLING THE TROOPS OUT BUT WILL LEAVE ALL THESE MERCENARY FORCES IN PLACE TO RUN ROUGHSHOD OVER THE LAST LIVING PEOPLE OF IRAQ. THAT WAY I CAN MAKE IT SOUND LIKE WE WILL HAVE A TROOP PULLOUT BUT NOBODY WILL KNOW WE'RE STILL SPENDING TRILLIONS OF DOLLARS OF THE AMERICAN TAXPAYERS MONEY FOR THESE HIRED GUNS. YOU KNOW, THE MONEY WE COULD BE SPENDING HERE ON VETERANS, EDUCATION, INFRASTRUCTURE. THEY CAN CONTINUE THEIR WAR OF TERROR ON THE CIVILIAN POPULATION OF IRAQ.

WTF BARACK? HAVE YOU NO SHAME?

Tonight we finally saw Regina Spektor and it was worth the wait. She was artistically fantastic and was very happy with her Nashville audience. After cancelling and rescheduling three times I am guessing she wasn't expecting a happy group. She was mistaken. People were singing along and she would stop and let the group sing. We saw Ali there from Vox. She called me when the opening act "Only Son" was taking the stage but made it there during the break and for Regina. It was good seeing her. We may go out for her birthday in March. It was a great show. My pictures are lousy but we had a good time. Her voice sounds like a studio recording and I like for the songs to sound like the ones I listen to. Sometimes performers live don't make a great impression when you like the way the songs sound on the CD's.

Some cities have statues of famous Patriots or War heroes. Nashville has a 10 foot high Billy Graham and a big honker of a crucifix. If it weren't so cold Kevin would have sat on Billy's shoulders. Pretty effing creepy, nes pas?

Memorial Gym was the center of the Athletic Universe last night as the Vanderbilt Commodores beat Top Ranked UT for a huge victory. The biggest in Vanderbilt History. Kevin and I have gone to every game for both the men's and women's Basketball and have had a great time. The Dores beat UT by three points at the buzzer. Just two days before UT played number one Memphis and took the top spot. Tickets sold for $10,000. A record for college basketball. Ours were only $40. but I get a 75% discount. One of my students told me he couldn't work because he had Mid-terms. I said "Okay, see you at the game tonight",lol. He was there and Jazzeline, one of my other students plays in the band. I usually see the kids at the games. We had a blast and the fans went absolutely crazy. There is a good chance we will make it into the Sweet Sixteen and maybe the final four. Who knows, it could be our year to win the entire thing. We'll see. We only have one woman's game left and two men's games. Then the SEC tournament for Woman's Collegiate Basketball will be in Nashville. The opening of March Madness. The men will play in Atlanta. Last year our Ladies Team won the SEC Championship. One of the most prestigious honors in Collegiate Athletics.

Invited to speak about our horrible experience in Florida in February 2007 - Family Equality Council (previously Family Pride) - this is the speech I gave on 10/13/07 at the Hollywood Roosevelt when Jamie Lee Curtis received her award along with Growing Generations.

as promised, i have just gotten back to our room - here is my speech. 10:40pm

Good evening, I am Janice Langbehn. In trying to prepare for tonight’s speech and express to you how family equality is essential I am saddened to think the only reason I am up here is because my partner died. Some of you may have heard our story. In February 2007, my partner, Lisa Pond, and I arrived in Miami, Florida with three of our adopted children to realize a family dream – a weeklong vacation on RFamily Cruises. As we boarded the Norwegian Jewel, Kelli O’Donnell greeted us and had our picture taken. None of us realized it would be one of our last family photographs. We also did not anticipate the unimaginable homophobia and inhumane treatment we would be faced with just a few hours later. While I unpacked in our cabin, Lisa, my partner of 18 years took our kids Danielle, David and Katie up to the top deck to play basketball. Just a short time later the kids were banging on the stateroom door saying, “Mommy was hurt!” I opened the door, and took one look at Lisa and knew the situation was very serious. As a medical social worker for many years, I have seen people in critical condition. I knew that my life partner was gravely ill. As the ship was about to leave, we had no choice but to seek medical help in an unfamiliar city. After local medics arrived, we hurried off the ship to the closest hospital in Miami, Ryder Trauma Center at Jackson Memorial Hospital. The kids and I, hauling a week’s worth of luggage for five, arrived just before the ambulance carrying Lisa. I tried to follow the gurney into the trauma bay but was stopped by the trauma team meeting Lisa and told to go to the waiting area. I did as I was told and a short while later a social worker appeared to inform me that I was - and I quote – “in an anti-gay city and state.” He explained that this meant that I would not be allowed to see Lisa or make decisions about her care without a Health Care Proxy. I asked for his name and fax number and within 20 minutes I had contacted close friends in Olympia, WA who raced to our house, found all our legal documents including our Durable Power of Attorney, Living Wills and Advance Directives and fax them to the hospital. I never imagined as I paced that tiny waiting room that I would not see Lisa’s bright blue eyes again or hold her warm, loving hands. Feeling helpless as I continued to wait, I attempted to sneak back into the trauma bay but all the doors to the trauma area had key codes, preventing me from entering. Sitting alone with our luggage, our children and my thoughts, I watched numbly as other families were invited back into the trauma center to visit with their loved ones. I was still waiting to hear what was happening with Lisa, realizing as the time passed that I was not being allowed to see her and if the social worker’s words were any indication it was because we were gay. Anger, despair and disbelief wracked my brain as I tried to figure out a way to find out what was going on with Lisa. I finally thought to call our family doctor back in Olympia to see if she could find out what was happening. While on the phone with our doctor in Olympia, a surgeon appeared. The surgeon told me that Lisa, who was just 39 years old, had suffered massive bleeding in her brain from an aneurysm. The surgeon asked me for consent to place a pressure monitor in her brain. It was only then, hours after the documents had been faxed, that I knew that they had been received by the hospital.A short while later, two more surgeons appeared and explained the massive bleed in Lisa’s brain gave her little chance to survive and if she did it would be in a persistent vegetative state. Lisa had made me promise to her over and over in our 18 years together to never allow this to happen to her. I let the surgeons know Lisa wishes, which were also spelled out in her Living Wills and Advance Directive. I was promised by the doctors that I would be brought to see Lisa. Yet I was still waiting when a hospital chaplain appeared. I politely requested a Catholic Priest be brought in to administer Lisa’s Last Rites. The chaplain offered to pray with me, and I remember staring at her wondering – what did she think I had been doing for the last several hours but praying? <span style="FONT-SIZE: 12pt; With the priest, I recited the ritual of the Last Rites and prayed for Lisa and held her hand for the first time since she arrived at Ryder Trauma Center. Following my few minutes with Lisa, the priest ushered me out to the waiting room again. After finally seeing Lisa, I knew our children and I needed to be with her and I asked over and over if we could go back again and was repeatedly told by hospital staff, “No”. <span style="FONT-SIZE: 12pt; Jackson Memorial Hospital, in their inability or unwillingness to recognize us as a family with legally adopted children, forced Lisa to be alone in her last moments of life. <span style="FONT-SIZE: 12pt; I showed hospital staff our children’s birth certificates with Lisa’s name on them and was told they were “too young to visit”. I thought to myself “how old do you need to be to say goodbye to your mother”? In those hours of waiting and trying to calm our children, explaining to them that their “other” mom was dying and would go to Heaven, I felt like a failure. <span style="FONT-SIZE: 12pt; They talked directly with me and allowed me to choose which organs would be donated and allowed me to sign all the consent forms. It is only now, eight months after Lisa’s death that I can gain more perspective and with that insight has come anger at how we were treated. Lisa and I were together 18 years, had become foster parents for the State of Washington when we were just 24 and 25 years old. After being guardians to a teenager until she graduated from high school, taking in 22 foster children and then adopting four children, I realized that we were fortunate in our life together. We had each other; we lived in a community where our adopted children were never harassed for having two moms. Lisa was a “stay-at-home mom” and very involved in our children’s lives from teaching all our children’s first communion classes to volunteering at their schools, sitting on the PTSA for 2 years and serving as our daughters’ Girl Scout leader for the past 8 years. Her troop was so popular it swelled to 26 girls at one point. Lisa never turned anyone away. When we did face inequality, we just found other ways to meet our children’s needs. Truly until February 18, 2007, I can only think of a handful of times when I felt out of place as a family. However, I now believe that a family – however they may define themselves (GLBTQ) – has the human right to be together is at the time of death. Yet, in our situation not only were we not validated as family we were actually shunned. All because, as the social worker made very clear, I was in an anti-gay state, as if I should just accept that. Yet I had no choice. He and the hospital held the power to allow or not allow our children and me the basic human right to hold Lisa’s hand while she was still alive. They stole that time from Lisa, our children and me, and that time can never be given back. So as I move through my grief and help our children through theirs, I speak out for family equality and basic human rights. I believe with all my heart, that at the hour of Lisa’s death, no one should have been able to deny our children and myself the ability to say goodbye to Lisa and let her know – if only be holding her hand – that she was so loved. That should not be a privilege in our country but a basic human right of every family regardless of how they define themselves. If you remember nothing else from tonight, I hope you have come to understand that even with legal paperwork it is a reality that someone can leave this earth completely alone even though their loved ones are just 20 feet away. No family should have endured what we did that night in Miami at Jackson Memorial Hospital. It was wrong, insensitive and a defining moment for my family that can never be replaced or forgiven. Lisa Pond was a wonderful caring person who gave endlessly to others. She took care of countless children when they were abused or neglected. She nurtured even more through her community service and as a Girl Scout Leader. Through organ donation, four people received another chance at life when they received her kidneys, liver and heart.

Documentary On Dying Lesbian Cop Wins Oscar
by 365Gay.com Newscenter Staff

Posted: February 25, 2008 - 7:30 am ET

(Hollywood, California) A documentary film on the struggle by New Jersey police officer Laurel Hester's struggle to have her domestic partner recognized as her next of kin has won an Academy Award.

"Freeheld: The Laurel Hester Story" was directed and produced by filmmaker Cynthia Wade. The award was presented Sunday night at the 80th Annual Academy Awards, held at the Kodak Theater in Los Angeles.

"We are thrilled that this powerful film, one that has the potential to change hearts and minds concerning fairness for gay couples, has been honored," said Neil Giuliano president of the Gay & Lesbian Alliance Against Defamation. "We congratulate Cynthia Wade on her achievement and say ’bravo’ to the Academy for their selection."

Hester had been a lieutenant with the Ocean County Prosecutor's Office. Diagnosed with terminal cancer she was forced to retire. In late 2005, as the disease progressed she appealed to the Ocean County, New Jersey freeholders to give her same-sex partner her death benefits.

Although New Jersey recognized same-sex couples it left it up to local governments to determine if benefits should be offered the partners of employees.

After listening to her request, and her concern that when she died her partner, Stacie Andree, might lose their home, with little discussion the freeholders rejected the request.

The story was picked up across the country and as pressure mounted on freeholders she was allowed to make a second plea a month later. Filmmaker Wade traveled to Ocean County and chronicled the events that followed.

Too ill to appear in person Hester (pictured) appeared via video tape from her hospital room.

In a frail voice, and often gasping for air, Hester begged for recognition of her partnership with Andree.

"All I'm asking for is that you sign the resolution and that you make a change, a change for good, a change for righteousness and a change in the lives of so many people that have dedicated themselves to county government."

After the moving tape was played a second vote was held and resolution passed.

A month later Hester died. (story)

"Freeheld: The Laurel Hester Story," premiered last year at the Sundance Film Festival.

Wade said that she promised Hester she would submit the film for consideration for an Academy Award.

Garden State Equality which had lobbied freeholders on Hester's behalf held an Oscar party in New Jersey to watch the awards presentation. Members let out a cheer when the award was presented to "Freeheld".

Garden State Equality chair Steven Goldstein said the film should spur on state lawmakers to amend the civil union law to provide for full marriage for same-sex couples.

"Because of the failure of the civil union law, there are new Laurel Hesters all across New Jersey," said Goldstein.

" Same-sex couples denied equal benefits by employers, struggling to make ends meet, struggling to maintain their dignity, in the face of a civil union law that segregates, discriminates and humiliates."

Last week a government commission released a report saying the civil union law had failed to provide the same equality as marriage.

A friend sent me this website of the Langbehn- Pond family and the blog about what this past year without Lisa Pond meant to them. Janice discusses each milestone including birthdays, holidays, and anniversaries. This is beautifully touching and it would give you a little more insight into this family, blended as they are and you can also sign the guest book to let them know that you are behind them. The pain has not yet left. Just the realization still that Lisa was alone and didn't have to be.

Thanks to all of you who wrote to the Hospital. I hope many more people do and I spent the day writing to every major publication and News channel I could find an address for. Also as many famous people as I could.

Charge me higher taxes. Discriminate against me if you must but don't espouse family values and deny a deathbed farewell to a loving partner of 18 years.

(Miami, Florida) Janice Langbehn and Lisa Pond had planned to take their three children on a family cruise. The Olympia, Washington couple had been together 18 years and with their children were looking forward to the holiday.

But just as they were about to depart on the cruise from Miami, Florida. Pond, a healthy 39-year-old, suddenly collapsed. She was rushed to Jackson Memorial Hospital in Miami with Langbehn and the children following close behind.

But once Langbehn and the children arrived at the hospital the hospital refused to accept information from her about Ponds’s medical history.

Langbehn says she was informed that she was in an antigay city and state, and she could expect to receive no information or acknowledgment as family.

A doctor finally spoke with Janice telling her that there was no chance of recovery.

Other than one five minute visit, which was orchestrated by a Catholic priest at Langbehn’s request to perform last rites, and despite the doctor’s acknowledgement that no medical reason existed to prevent visitation, neither she nor her children were allowed to see Pond until nearly eight hours after their arrival.

Soon after Pond'’s death, Langbehn tried to get her death certificate in order to get life insurance and Social Security benefits for their children. She was denied both by the State of Florida and the Dade County Medical Examiner.

With the help of Lambda Legal Langbehn has notified Jackson Memorial Hospital that she intends to file a lawsuit.

"There is nothing that can make up for what my children and I endured that day,” Langbehn says of the day Pond died. “We only want the hospital to take responsibility for how they treated us and ensure that it doesn’t happen to another family.”

In accordance with Florida law, Lambda Legal is waiting for the hospital to respond to the notice of intent to sue before formally filing a complaint with the court.

"The treatment that Janice and her children received was unethical and discriminatory," said Beth Littrell, Staff Attorney for Lambda Legal.

Suggestions Lincoln, Buchanan Gay Roils Historians
by 365Gay.com Newscenter Staff

Posted: February 18, 2008 - 5:00 pm ET

(Washington) As the country observed Presidents' Day the debate over whether two former Presidents - James Buchanan and Abraham Lincoln - were gay continues.

James Buchanan was born in 1791 near Mercerburg, Pennsylvania. He was elected five times to the House of Representatives; then, after a serving as ambassador to Russia he was elected to the Senate where he served for a decade.

Buchanan became Polk's Secretary of State and Pierce's Minister to Great Britain. Service abroad helped to bring him the Democratic nomination in 1856 because it had exempted him from involvement in bitter domestic controversies.

The 15th president of the United States was the only bachelor to serve in that office and his private life soon became fodder for Washington wags.

For Buchanan had lived with William Rufus King, the Senator from Alabama.

The two were inseparable and the friendship did not go unnoticed.

Andrew Jackson dubbed King "Miss Nancy." Aaron Brown in a letter referred to King as Buchanan's "better half," "his wife," and "Aunt Fancy . . . rigged out in her best clothes."

When Buchanan appointed King ambassador to France in 1844 the president wrote to King saying that "I am selfish enough to hope you will not be able to procure an associate who will cause you to feel no regret at our separation."

Historians for decades have debated whether the references showed a love attachment between the two or whether the friendship was blown out of proportion by political foes.

The friendship between Abraham Lincoln and Joshua Speed is equally contentious.

Noted gay author C. A. Tripp in The Intimate World of Abraham published in 2004 shortly before Tripp died, lays out what the author says is the evidence Lincoln had a gay relationship with Speed.

Tripp was a noted psychologist. He previously wrote The Homosexual Matrix and was a researcher for the Kinsey Institute. The Intimate World of Abraham was the result of more than 20 years of studying Lincoln's private life.

Using the methodology of the Kinsey sex-research model he probes Lincoln's personal relations with men and women and concludes that Lincoln was unnaturally uncomfortable around women, never had a love match with Ann Rutledge, suffered through a strained marriage with Mary Todd Lincoln, and had a gay sexual relationship with his longtime friend Speed.

He also details the relationship Lincoln had with another man with whom he shared his bed, David Derickson, captain of his bodyguards. As well, Tripp describes another lover who said Lincoln's thighs 'were as perfect as a human being could be'.

The book contains a poem discovered by Tripp that was written by the young Lincoln which includes the lines:

Billy has married a boy
The girlies he tried on every side/but none could he get to agree
All was in vain he went home again/and since that is married to Natty.
